Iraq veteran and honorably discharged Marine Sgt. Adam Kokesh has been the Pentagon’s biggest public relations nightmare this year, because he’s some kind of magical Cindy Sheehan — people actually like him!
And while right-wingers had no problem mocking the mother of a soldier killed in Iraq, they have a tougher time mocking an actual living Marine male veteran who actually fought in the war they just write about on their blogs. Plus, you get the feeling he wouldn’t mind beating the shit out of, say, the entire staff of National Review Online … and that they’d probably enjoy it, too.

Kokesh and his anti-war veteran buddies have pulled several picture-perfect stunts in Washington, including a mock military funeral at the Hart Senate building and keeping score of how many times Alberto Gonzales said “I don’t recall” during his Senate grilling last month.
The funeral stunt earned the protesters a coveted “political protest” arrest — apparently it’s now illegal to protest anything for political reasons — and your favorite Marine was also charged with “Unlawful Assembly — Loud and Boisterous,” despite the fact that he was silent during the performance.
For this, the Marine Corps is now “investigating” Kokesh, even though he’s officially out of the Corps and banished from reenlistment due to bringing home an Iraqi pistol for his war souvenir — that’s against the rules if you get caught!
On Monday, Kokesh has to show up at a hearing so the Corps can re-discharge him, this time dishonorably. Why? Because even when you get out of the military these days, Rumsfeld’s “back door draft” makes you eligible for another call-up because there aren’t enough people volunteering to jump in the Baghdad Meatgrinder. But they don’t want him back, even for the Individual Ready Reserve. So what’s the point?
All the chickenhawks will have permission to call him a traitor or whatever on the blogs and talk radio if he suddenly becomes dishonorably discharged, that’s the point!
The hearing will be, of course, in Kansas City. If it was held in or around Washington, there would be a riot. Even Wonkette commenters would leave their computers for the cause of America’s Favorite Marine. WAIT A MINUTE, dude has a bus going to KC! It leaves Union Station tomorrow at 6 p.m. There’s a press conference at 5 p.m. Friday, right before the bus leaves.
UPDATE: Wonkette’s Intrepid Girl Reporter Liz Gorman will be there at Union Station taking lovely photographs of this event. And then everybody can walk over to the Red and the Black or something and get drunk and levitate the Pentagon or whatever.
Hopefully Kokesh will stop by the comments and give us some more filthy details. He already turned down a “plea bargain” that would force him to have a pro-war talk show on AM radio or something ….

I created a comprehensive website about the antics of Matt Sanchez, the porn actor and former (?) prostitute whose history was revealed after he accepted an award from the wingnut CPAC in March. Along the way, I got an in-depth education about military law. Parts of Sgt. Kokesh's story raise questions.
First, a minor detail. His site refers to Kokesh as a member of the "Inactive Ready Reserve." I believe (but could be wrong) that the Marine Corps uses the term "Individual Ready Reserve" to describe people who've completed active duty and have no obligation other than to report address changes to the military in case they are called back.
Second, I believe an IRR member such as Kokesh (and Sanchez, by the way) is legally a civilian, and as such not subject to the Uniform Code of Military Justice for anything he does. If there's a UCMJ provision that governs the wearing of military uniforms by IRR members, I'd like to know what it is.
Third, the Marine Corps did not "prosecute" Kokesh, as his website claimed. There is a bright-line distinction in military law between prosecution and administrative actions; the former can bring punitive sanctions such as imprisonment, while the latter cannot.
Kokesh's website does not detail the "plea bargain" he said he was offered, or the legal basis for the Marine Corps' move to discharge him from the IRR on an OTH basis. Server space is so cheap as to be free, so I wish Sgt. Kokesh would publish all of the correspondence between himself and the Marine Corps, and that his lawyer would state the specific regulation that Kokesh is said to have violated. And I'd like to know what IRR stands for with respect to the Marine Corps.
Please don't assume that, by posting these questions, I either support or oppose Kokesh. In fact, I have mixed feelings about the case. But, before I state an opinion, I'd really like to get more accurate, detailed information.

I am disgusted and not surprised at all. This is my first visit to your site and I have to say that I got what I expected. The fact that "your team" utilizes an audition/approval process for posters is nothing more than censorship. I did not read one post above that even entertained the the fact that there is another side to the subject. 1. Your posterchild was not, I repeat not discharged. He was released from active duty and still has an obligation. There is a big difference. A DD214 is not a discharge certificate. He knew when he enlisted that he was subject to an eight year obligation. This was implemented in 1984, not by Rumsfeld. I.R.R. service personnel are aware that they may be called to serve at any time for any reason while in an inactive status and that they are subject to the Uniform Code of Military Justice.
2. He was released from active duty as a Corporal; not a Sergeant.
3. Telling a Marine officer(s) to "fuck off" is considered disrespect under Article 89 of the U.C.M.J. whether it is to his/her face or via e-mail.
4. While in the I.R.R., participating in political activism while wearing uniform articles is prohibited. Even if his name tapes were removed it is still a breach because of his status.
5. In actuality, your masterbation fantasy boy is lucky that there are not other offenses included in the separation hearing.

Not knowing you, it is impossible for me to interpret your post. If you are attempting to imply that my earlier post was "anti-troop"; you couldn't be further from the truth. I am a former Marine, my wife is a Marine, my nephew is a Marine currently in Iraq for the second time and most of my friends are Marines who have been in the Iraq theater at least one tour, most of them twice.
My comments were driven by the misinformation being spewed here and many sympathetic media outlets. I am disgusted that this person has chosen activism over fulfilling his responsibilities. Just because he served in Iraq does not allot him supreme moral authority to conduct himself in a manner which contradicts his obligation to live within the perameters of the UCMJ.
He has stated that he still loves the Marine Corps yet he signed his disrespectful e-mail (telling the Major to "fuck off") with the designation of PFC. This of course represents Proud Fucking Civilian vice Private First Class.
The Marine Corps shouldn't be ashamed of their proceedings. He should be ashamed of his behavior.

However, and with all due respect, the Marine Corps is quite wrong on this, even if, technically, they may have the legal right to do so.
As a member of the IRR, Kokesh is not part of a unit, does not train and receives no pay. The Marine Corps knew his current contact information. I fail to see what "responsibilities" Kokesh did not fulfill.
The idea that IRR members can be subjected to the UCMJ for lawful exercise of their First Amendment rights is, frankly, chilling.
I mean, if everyone in the IRR is subject to the UCMJ, we should be seeing a lot more investigations and prosecutions of ordinary crimes committed by recent veterans. Instead, I think that the military allows local authorities to exercise primary jurisdiction, and in the case of Kokesh, no jurisdiction at all.

I beg to differ! As a member of the IRR, he is part of a unit. He has a Commanding General, a Sergeant Major and administrative personnel responsible for maintaining his records. He can check out MCIs, gain retirement points towards a reserve retirement, go on active duty (ADSW) and even get promoted if he chooses to work towards it. He is also subject to an annual administrative screening. As far as his responsibilities, I addressed that earlier. When he enlisted, he did so knowing that he had an eight year obligation. He could have remained on active duty for the entirety or split that time between active, active reserve and/or inactive reserve. It is an individual decision. Regardless, even while in an inactive status (IRR) he is subject to the UCMJ.
Yes, he was exercising his free speech rights but in an illegal fashion. DOD regulations prohibit the use of uniform items while participating in political activism. He received a warning after the mock patrol as did others. Unfortunately, he made a personal decision to defy the warning.
No jurisdiction? His Commanding General has jurisdiction because he presides over the IRR. Get it? His offenses were not ordinary crimes. Local authorities/municipalities don't have jurisdiction in UCMJ matters unless it is also a crime within their boundaries (theft, DUI, etc.). Disrespect towards a superior commissioned officer and utilizing military uniform items while participating in a public display of dissent was and should have been addressed as they were.

There are some pretty glaring misunderstandings going on here.
As an IRR memeber, he has no "discharge status". One isn't discharged until the end of one's statutory commitment. For example, while I originally enlisted for 4 years and extended that active service time for 2 more to 6 years, I wasn't discharged until the end of the 8 years' liability I had signed for upon enlistment. So it isn't about "changing" anything, it's about a guy under the UCMJ breakig the law and being punished accordingly
If nothing else, just wandering around in BDUs in downtown DC is punishable. BDUs are to be worn only on active duty, on a military base or heading between active duty and home.
All that said, I now want to see EVERY uniformed service member loitering around Move America Forward rallies or the Republican National Convention jacked up. It is expressly forbidden for servicemembers to attend political rallies in uniform. Fair is fair...

My own favorite and very brave Marine had very shinny shoes and we always wondered how he did it.
jarheadforever is correct about the regulations. I looked into this one closely, and while I'm not a lawyer I think the USMC is on pretty solid legal ground under DoD Directives 1332.14 and 1334.01. There is a good argument the other way that essentially boils down to selective enforcement. Here is my complete devil's advocate argument in favor of Kokesh:

For me, the bottom line is that I'm on the USMC's side of this one, with some reservations about selective enforcement. I think the deciding factor for me is the utter disrespect that Kokesh showed to the Marine Corps. Not in his protest, but in his correspondence.
I appreciate Kokesh's service and I respect and agree with with antiwar views. But, in view of the way he dealt with the USMC, it's hard for me to have too much sympathy for him in the uniform case.
Last time I checked, wich was May 2006 when I retired from the Marine Corps, the "boonie cover", which Sgt. Kokesh was seen wearing is not an oficially authorized uniform item, despite the EGA, so the DOD directives 1332.14 and 1334.01 do no apply.
