But he can require federal employees back to work, and then fire any who don't show up. Flex his "muscles" and thin out the deep state! Win/win!

The Constitution, Article I, Section 9, Clause 2, states that suspension of habeas corpus can be ordered by Congress "The Writ of Habeas Corpus shall not be suspended, unless when in cases of Rebellion or Invasion (capitalization theirs) the public safety may require it." Black and white "Rebellion or Invasion" period. The founders often cited particular conditions when they thought those things extra important, such as the Bill of Rights. The conditions caused by a health emergency do not qualify for suspension of that right.
