What's important to this judge is that Church money is "free speech". We know Scalia will agree (and will proceed to find it in the original intent of the Founders.), but otherwise there's not a whole lot of win here, if/when it reaches the SCOTUS.
Based on personal experience, most would be surprised to know that a secretary in a parish office cannot bring a discrimination or whistleblower action because "personnel decisions in a religious organization are immune from judicial review." I know my client was surprised.
Plus once the offender gets to Heaven he can just say the Devil made him do it and skate right in.

I'm sure the victims would be fine if compensated by a work of priceless art or similar. They have lots of that.
