Lack of ironclad evidence to prove to a jury that HE is THAT perpetrator is yet another: prosecuting attorneys won’t charge a case they don’t think they can win — and if the ID is uncertain enough that the defendant could successfully claim mistaken identification and sway a juror to deadlock the jury or worse yet win an acquittal, there’s no point charging. The biggest problem was that no-one got a picture of Umbrella Man’s full *face* — and to have had all this talk about “maybe it was a cop” surely has been a great argument for an actual Hell’s Angel (or any other non-cop) to use in his *own* favor.
Name and photo are here though, and his eyes match the masked Umbrella Man’s* at least as well as the police officer some had accused (who was determined to be elsewhere at the time). I doubt they’d have been released at all if he were either an undercover officer or a CI.*photo
