That's my thought. Brandon says "as an official act, I need to safeguard democracy, so I am throwing the orange orangutang's ass in the Colorado Supermax prison. He'll not have access to the internet, or a phone. He's going to be guarded by the military. Anyone got a fucking problem with that"? Then call the sane members of the military, and let them explain to Magat trash that their God is going to be cooling his heels in jail until he croaks. He SHOULD have been dealt with in the old school way we used to deal with traitors on 1/7/2021 by the military.

Aside from actually Googling it…what’s the odds that at least one state GOP House contingent has the tiniest blackened, shriveled, stinking fragment of a soul left, and would refuse to vote for an Assmouth win? Especially if their state has a GOP majority in the House but voted for Harris (looking at you Wisconsin).

Let's say Dems DO win a YOOOGE majority in the House.

What IF in the wake of that Mike Johnson (backed up by his honcho attorneys, ignoring their oath to the Constitution) refuses to step aside??

With all the latitude accorded to House Members under Speech and Debate together with the fact that he's running unopposed -- Louisiana does not get enough money from the national Democratic party to mount a serious challenge in a Confederate state (don't get me started on that one) -- he will be returning to his seat.

What then?

I'm not sure if there's a *legal* way for him to stay if he's no longer Speaker, but I suppose that's what the Sergeant-at-Arms is for supposedly in the House. The unreconstructed Republican Party is definitely giving us our Constitutional Law exercises for sure.

I do know a critical difference in that at such a time the Capitol will be more protected in case cultists try getting cute or whatever. I don't know that there ever was a mechanism for a Speaker to just not cede especially since the Speaker is elected by a majority vote of the House.

It's not going to work for Speaker Covenant Eyes to say that the ballots electing the House majority as Democrat are wrong; because he's elected on the same ballot. Presumably if there is an objection that would mean nobody is seated or something. I'm definitely not a Constitutional lawyer. But I don't see the mechanism by which he could just decide that he's Speaker for life if the members vote. Is the proposed mechanism that he just never holds the vote?

That's what makes a lot of this difficult - it would be a case of first impression

(and I feel like you know a bit about how reluctant this country's jurists can be to wrestle with such a thing, and will go to some serious lengths to avoid it if they can)

The real Calvinball comes in with the SCOTUS but really I don't believe they'd have any standing on the House Speaker succession because that's internal to Congress, and separation of powers. We all know the basic premise that if there's a party helping Black people it's not going to be able to tap into power. That's after all part of shitting on cities and any rural Black Belt counties, and making sure they're gerrymandered to fuck.
