There are a thousand ways to F up being a practicing attorney. But you can avoid most trouble by being honest (believe it or not); respect judges and be cordial and polite with them, and follow their orders; don’t overlook statutes of limitations; don’t steal client funds; and don’t abuse the system by filing frivolous lawsuits as retribution the way many Trump attorneys and Roy Cohn did.

It’s just incredible how foolish these Trump sycophant lawyers are. Halligan and Habba are two similar examples of climbers who are willing to accept any order or mission from Trump or his underlings because of their combination of ambition, naivety and apparent utter lack of self awareness. Habba was inexperienced and unqualified to defend Trump in an actual trial, and it showed as she was unfamiliar with how to introduce evidence, and was repeatedly scolded by the judge(s) for her behavior. Being sassy and full of shit isn’t super successful for very long. You run out of luck sooner or later doing that. Halligan was arguably even less qualified, certainly to be appointed a U.S. attorney specifically to attempt to indict a former head of the FBI on some vague and dubious charges to scratch Trump’s vendetta itch. That was a fool’s errand if there ever was one, but she was willing to take a stab at it and see how it goes.

Years ago, I handled a very important case in state court that got removed to federal court. More rules, electronic filing requirements, and other complexities that I immediately recognized were over my head as a solo attorney. So I hired an experienced attorney who was comfortable with federal courts to co-counsel with me. I sacrificed a considerable portion of the fee to get the case right. I can’t imagine being a young lawyer who is used by the president of the United States to attempt to indict such a high ranking official on such flimsy charges, and just winging it. It’s just not a surprise that so many of his legal goons are later punished or stripped of their law license for agreeing to play along with this conman and his abuse of the system. If only our system had been strong enough to hold him accountable for being the true party responsible for all these abuses.

Humility, respect, honesty, integrity, and fair play, and wisdom that comes from experience, these are some of the things that serve attorneys well. And humanity, being a person who can communicate with people, that’s a vital skill if you want to avoid every case ending up in trial.

Some personal skin in this: I have spent my entire adult life mocking the town of Lewisville, Texas and its first high school, “Home of the Fighting Farmers.” That includes noting that the only reason to go to a class reunion is to watch everyone try to sing the football team fight song until they realize “Dueling Banjos” has no lyrics, that the school’s motto should be changed to “Come For the Meth, Stay for the Cow-Tipping,” and noting that Lewisville’s sole entertainments for decades involved cross burnings, book burnings, high school football rallies, and brother-sister marriages. (True story: Lewisville was a dumping ground for Southern Baptist ministers with a thing for teenage girls: my senior-year lockermate not only quit school because of her impending pregnancy by her church’s new preacher, but had to do a walk of shame during Sunday services reserved for unwed mothers…in front of the same minister who impregnated her.) In the last 40-odd years since I graduated, I keep getting more and more reasons to share the horrors of growing up in Lewisville: until last week, the biggest was the effort to preserve a defunct and collapsing water tower overlooking I-35 because the water tower was repainted to celebrate how the Fighting Farmers won the state playoffs…in 1996. However, this changes because of the acknowledgement that John Eastman is now Lewisville High’s most famous alumnus…and that as racist and bigoted as he is, he’s almost a moderate compared to so many of our classmates.
