San Diego prosecutors are doing their darnedest to make sure a man goes to jail for the rest of his life for a crime he didn't commit. That's not a matter of conjecture, like, "No, he's totes innocent." Prosecutors aren't even trying to say he committed a murder. Or that he planned, ordered, aided, or abetted a murder. Instead, prosecutors claim, this guy should spend the rest of his life in jail because he cut a rap album, and that rap album sold more copies because murders were committed. That's the San Diego D.A.'s story, and he's stickin' to it.
or Darrell Issa should be serving a life sentence given that his life of grand theft auto benefited him greatly when he turned a profit designing auto alarms to thwart thieves like him.
So is this DA going to go after the guys who made paper targets of Obama now that nearly a dozen white folks have tried to get into the White House to kill him? Inquiring minds want to know.
Based on the article, it seems to me that the DA (and, I guess, the judge) are confusing the cause and effect parts of the law. The law says: if you commit certain felonies, and the commission thereof was directed by, or benefits, a gang, you get a more severe punishment. It does NOT say: if gang members (not you) commit a felony, and for some reason that causes <i>you</i> some hypothetical benefit, that you are automatically guilty of conspiracy.
The law may or may not be stupid, but the DA&#039;s interpretation is totally fucked up. (Note, from the story, I couldn&#039;t tell if there may be other evidence to indicate that the rapper was involved in a conspiracy.) I wonder if the judge might be allowing it to go forward so he can rule the law unconstitutional?
How can that rapper be innocent? In his photo, he is clearly blah. Lucky for him he wasn&#039;t carrying Skittles at the time of his arrest.
