There have always been exceptions to NCAs if one cared to fight, I know because I was one who stood up for what was due me. In the 80s I worked for a company that decided not to renew my contract -- in fact they terminated me just prior to renewal time -- and to try to enforce a non-compete clause. My lawyer made short shrift of this attempt and demanded that if the company wanted to stop me from working for a competitor they would have to pay me for the length of time they were trying to prevent me from earning a living in my chosen profession within my chosen industry. In the end, the company gave me six months severance and tore up the NDA rather than try to explain their actions in a court of law.
