It is possible he was prior enlisted. That’s really the only way to earn a traditional retirement as a captain. Would be even harder as a JAG, because they come in as 1Lt instead of 2Lt, saving them 2 years toward Capt.
He's not retired. He's "retired" in the same sense that anyone else who left a job after four years without getting fired is retired. He did four years active and finished his time in the IRR. There is no pension for that.
In any case, recalling anyone to active duty, in this case 18 years after being on active duty, to punish them under a set of laws that no longer applies to them is some bullshit. It's a fairly common thing I see crop up any time a veteran does something like this. The day they get out the oath they took is no longer binding and the UCMJ no longer applies. If they did retire the pension is for past service rendered and is not based on what's done in the future.
Ah I see. There was nothing which defined “retired” in his case other than the caption to the pic at the top, which described him as a retired Captain. As an actually retired military boy, I know you can’t retire as a captain UNLESS you were prior-enlisted or medically retired.
Mom, dad, and stepdad all served in the military. If there’s one thing I have observed about the military it is that they ALL bitch about the stupidity of the chain of command above them.
Still, it seems like there must be something in the UCMJ that says that calling for the execution of your superior in public oughta get your own court martial. I know, retired, blah blah blah. But aren’t they theoretically on reserve for twenty years or something?
