There was at least one historical example (Andrew Johnson) of the House voting to impeach before the articles of impeachment were written. So agreeing to let Treason Boy off the hook with no actual trial seems reasonably likely to be legal. I'm no constitutional scholar though.
Interestingly, the thing that nominally got Johnson impeached was very similar to what Trump did when he assigned Matthew Whitaker as acting AG, in contravention of the Vacancies Act.
