Yes, the most advanced country in the world, other than being hobbled by the economic devastation of WWI, an ineffectual Wiemar government and constant political upheaval. Never mind that the period Scalia is referring to was when Hindenburg seized control with emergency powers and ushered in an era of fascism that made those judges relatively impotent, those damned libby judges were engaging in judicial activism when they meekly rubber stamped the Nuremberg Laws. Tony, care to explain how all this argle bargle squares with your recent decision to overturn the Voting Rights Act with your ruling on Shelby County v. Holder? Oh, that's right, it's only judicial activism when you disagree with it...
