Project 13. Win the House, hold the Senate and Presidency and amend the Judiciary Act provide for a 13 justice Supreme Court. I have other ideas about how CONGRESS could change the federal judiciary for the better, in keeping with its constitutional authority to establish the system of federal courts (a single Chief Justice [the only Constitution mandated judicial officer], all the rest are just called Federal Judge, Appeals Courts are staffed by the Federal Judges as assigned by the Chief, Federal Judges assigned to the trial level Fed Courts in the various states by the chief, nobody can stay in one place more than 10 years, no judge can preside over cases in the state in which they voted prior to appointment) but just reforming the SCOTUS would be a good start.

A long time back I had the blinding revelation that homosexuality couldn't be a "choice" because no one would choose the life of abuse, discrimination and ever present threat of murder that gay men experience. Obviously the same is true for trans people. It's not a choice for them.

My late gay brother used to argue with straight guys who insisted it was a choice: so, you're saying you COULD have decided to go suck a dick just to be rebellious, right? And of course they'd freak out like ew, gross, no way. Yet somehow thought that he, a fellow male person, somehow could make a choice they couldn't imagine making for themselves.

“…compassion for the child points in both directions…”

HORSE. SHIT. Compassion points to self-determination and treating kids as though they might know who they are. Any other so-called “compassion” is hatred wrapped in a pretty wrapper.

They should wait! Wait until Mr. Trump is back in what he calls "the Round Room". Wait for tremendous advice that will come — we can do it very very quickly and at very low low cost very quickly from Mr. Trump once he's back in what he calls "that Round Room”. Two weeks! Max!

"Meanwhile, the Sixth was terribly concerned about equal protection ... of state legislatures. If citizens had a right to their own care, then states that banned trans health care would be less equal than states that protected access to that same care:

[S]ound government usually benefits from more rather than less debate, more rather than less input, more rather than less consideration of fair-minded policy approaches. To permit legislatures on one side of the debate to have their say while silencing legislatures on the other side of the debate under the Constitution does not further these goals.

No, really, they said that."

This honestly does not surprise me -- and SHOULD not surprise ANYONE who paid attention to what happened when Ed Blum led an innocuously-named fascist group to take away affirmative action from schools AND THEN AGAIN led another innocuously-named fascist group to take away the 00000.1% of venture capital funds being granted to Black women while the other 99.9999% of that money went to White men.

But not enough people cared about that to pay attention even when a whole bunch of us who were adversely affected predicted (correctly) whose rights would next be on the chopping block,, so ...

... at this point I feel like other than saying "PLEASE MAKE SURE TO MAKE A PLAN TO REGISTER AND VOTE SO THE 60 MILLION PEOPLE WHO LET DONALD TRUMP STEAL THE ELECTION DON'T OVERPOWER THE 60 MILLION PEOPLE WHO VOTED FOR HILLARY CLINTON AND OUTNUMBER THE110 MILLION WHO DIDN'T VOTE AT ALL" ...

... I'm not sure I have another suggestion.

Because so many people didn't care about the other people being hurt if they themselves weren't directly affected that that created the permission structure for the right wing to back all the rest of us against the wall to the point where we don't collectively have an awful lot of other choices left

I posted this on Facebook some time ago...

Sure are a lot of ignorant folks who are worked up about transgender and gender-fluid people. That's OK; ignorance can be fixed. It wasn't that long ago that parents and teachers punished left-handed children, forcing them to do everything right-handed. Left-handedness was *evil*... unless one had a good sinking curve ball.

We know better now, right? We accept left-handedness just as we accept differences in eye color.

Gender dysphoria is a real thing, with physical (genetic, horomonal, etc) causes. Sometimes it's mild enough for the individual that they can live in their bodies as is without treatment. Sometimes it's so severe that medical therapy is required. But it can't be fixed by forcing people to live according to their assigned biological sex.

Transgender and gender fluidity is no more "evil" than being left-handed. Take a deep breath and take the trouble to learn about this from credible medical sources. This will get you started.

Not being a woman, I'm not too familar with how to undress if one is a woman. Am I to understand that in order to get a bra even HALF off, I have to purchase another one? I bet that would get awful expensive!

I must be missing something.

[Note: this is a dumb joke, and only a dumb joke. In my defense, I am actually a Dad.]

I, too, am confused. Whose bra exactly am I to be getting half off? Am I to buy the second bra at full price and give it to her, or keep it for some incomprehensible reason?

I'm so lacking in skills to deal with this confusing modern world.

This isn't good. The Right already has their win from the Sixth Circuit, and the Court has sat on this one for months without feeling a need to do anything. Now, just as some of the conservative justices are looking to back off the historical practices hooey, they suddenly decide to take up this case, a TRANS case with maximum negative appeal to those same conservative justices, just in time to get them back into "fuck it, we'll just make up our own law" prayer meeting.

Sorry, I just can't buy that this court suddenly picked THIS case after sitting on it for so long in order to give trans people puppies and rainbows. There is fuckery afoot.

Equal protection from Gorsuch? He ruled that a truck driver, who left his disabled truck in below zero temperatures, could be fired for not following (completely lame) company policy to always stay with the vehicle. If a company salesman or manager did the same does anyone think they’d be fired?

I actually wrote a Substack article this weekend about how trans rights should be seen as a First Amendment issue instead of a 14th Amendment issue. There is something called the Spence test that determines whether or not something should be considered free speech. And under Spence, gender transition MOST DEFINITELY should be considered free speech. I'm sharing it here not to toot my own horn but because I think it's relevant.
