I think they are arguing that the common law prohibits states or the federal government from indicting a sitting president, not statute law. But, that's just as inane and indefensible.

Right now CONFLATION is the best and maybe only tool Republicans have. Presidents cannot be tried or convicted of crimes while in office, it’s true. That’s a lot different than saying he/she cannot be investigated, let alone impeached by the House in a process broadly outlined in the Constitution and specifically NOT obligated to follow all court procedures, and then once removed, prosecuted fully. It’s Impeachment, emoluments, obstruction, abuse of power: these are all such difficult ideas for Republicans to wrap their heads around as they claim to know the Constitution.
