It depends - there have been a few <em>legitimate</em> self-defense or defense of others cases where the aggressor got it in the back (either because they turned just before being shot, or the defender was behind them as they advanced on a third party). It's a lot harder to prove because the presumption is that being shot in the back indicates fleeing from the shooter, but it's not impossible.
