Oh man, I SO want that Aussie reporter to sue the government and police department for that petty, impulsive, cruel act of hatred in LA when she was shot from behind by a rubber bullet. That asshole should be fired and prosecuted for assault. She was armed with a microphone, turned away from the line of police and was interfering with no one. He was masked with a face shield. No doubt he felt anonymity and total impunity from consequences. He saw a chance to hurt a journalist and a woman at the same time and didn’t hesitate. Utterly pathetic and vile.
I think that "battery" is the proper legalese here. "Assault" sounds scary, but it is something else:
" an intentional act that causes another person to fear an imminent harmful or offensive contact. It doesn't require physical contact, but rather the threat of it. " Disclosure: I am not a law-talker, merely a pedant.
Ta, Robyn. Today at work we had our monthly all-employees town hall on Zoom. Among other things, one of the staff attorneys gave a presentation on what to do if ICE shows up at the clinic. We are to ask for a signed judicial warrant, and give out no patient information (which we can't do for anyone without a signed HIPAA form). We had another presentation on heatstroke/heat exhaustion; it was very timely. It was over 100º F. in The Bronx today.

Until some of these mofos suffer the consequences, like being charged with false arrest, lying under oath, impersonating an officer, whatever it takes, and then doing the time or paying the fine and being relieved of their job, nothing will change. The whole problem we are facing is that there are no consequences for bad actions.
To be fair, it’s not just cops, but all assholes who won’t let little things like video evidence dissuade them from trying to get their way. I once had a customer who insisted I personally screwed up his meds and wanted me punished for it; the fact that it was clearly another employee(and I was on vacation that week) didn’t stop him from insisting we were wrong about the time and incident. You know it’s bad when even upper management(normally happy to throw an employee under the bus to make a problem go away) told him in the kindest possible terms to fuck off.
