There’s a good argument that someone who doesn’t have any particular personal animosity toward a vulnerable group, but who throws the group under the bus for political convenience or gain, is worse morally than a true believer who does have that animosity and persecutes that group even if the believer suffers in the process. What I think is happening is that that particular federal judge is buying the American people time to educated themselves
