I think you're right. It's like calling a clip a magazine or vice versa.

If Trump had led the mob to the Capitol and busted out the first windows, then pulled the trap door to hang Pence, the Republican senators would stick with "we can't do anything. He's no longer president". That's why his attorneys had to respond to a federal appeals court judge that if Trump did shoot and kill someone on 5th Avenue, he could not be indicted as long as he was in office. They went even further saying he could not even be investigated. Any other response would have signified that the DOJ memo on indicting a sitting president was not a blanket prohibition, but depended on the seriousness of the crime.

The judge could have asked if Trump machined gunned kids at the White House Easter Egg Roll, could he be arrested. They would have had to say he could not be arrested or indicted. Meaning the only way to keep him from running wild on Pennsylvania the next day would be to use the 25th Amendment or impeachment. Processes that would take weeks while he continued to kill people. It also shows that memo is bullshit and intended for frivolous claims running through a carefully selected prosecutor and judge, not serious crimes.

In this case, the GOP has decided they can avoid the whole can of evil worms by basically calling the "no standing" card, dismissing the whole thing. Regardless of how much proof of incitement or conspiracy the impeachment managers present.

I think Democrats will present a mountain of evidence. They just don't think the GOP senators will do anything about it. You can't make a crook do the right thing. If you have a jury half full of mobsters you are not going to get a conviction of their boss.

Democrats CAN produce lots of evidence, in fact, anyone who follows what happens can.

It's just that the GoP have shown an unwillingness to care about evidence, so why waste time?
