One solution would be to include in the articles of impeachment an obstruction-of-justice charge based on the incident, to call McGahn as a witness at the trial in the senate, and to have Chief Justice Roberts overrule the privilege claim on the spot on the basis that it was waived during the Mueller investigation and is subject to the crime-fraud exception under US v. Nixon.
