It's very clear that Maga is showing its fangs as an eliminationist cult. How else are we to understand a message like (to paraphrase) "no unity with the Left is possible"? Well, you don't really need warm-and-fuzzy "unity," you just need an agreement from both sides not to try to eliminate the other. Apparently, Vice President "JB Mandel" isn't interested in that kind of agreement.

Oh, here's the thing.

Apparently, neither the Orange Canklesaurus nor his crack legal team have ever read (or maybe even heard of) a little SCOTUS decision called Times v. Sullivan 1964. A minor civil functionary in Alabama by the name of Sullivan sued the New York Times for defamation, claiming the paper ran an ad that somehow defamed him by calling him a racist--which he was.

It was litigated all the way up to the Supreme Court, which ruled that as a public figure, the bar for defamation was set very high and that the truth is an absolute defense. This case also established the standard for 'absolute malice' and 'reckless disregard for the truth'.

The NYT and its subsidiaries printed the truth about our Orange Leader and he doesn't like it. Tant pis! Endorsing Kamala Harris for President doesn't constitute election interference.

I find all of this hilarious. He was able to extort money from ABC and CBS because they are cowards and because the feds have controls over both networks. CBS especially because they were in the midst of a buyout for which they needed FCC approval.

But the NYT doesn't hold any government licenses and doesn't get any money from the feds. The paper has the 1st Amendment. They've been down this road before.

Let him go. Discovery will be oodles of fun.

He has no case.

Maybe. But I don't think he's that smart. Neither he nor his legal team.

The only one on SCOTUS who seemingly has expressed any appetite for overturning Sullivan is Thomas.

While the current Court is clearly no respecter of precedent (Roe, cough, cough) even RBG felt that there were better grounds for that decision.

So, who knows?

This will be interesting. Orange has threatened to sue the Times before. Famous letter from David McCraw (Times' legal counsel) to Marc Kaseowitz. It's a classic and worth looking for.

Maybe quibbling with semantics is just more deck-chair arranging in the current era, but I am so goddamn sick of them stripping words of meaning by using them to mean Everything I Don't Like. Sneaking fentanyl into Tylenol would be terrorism. Packing it in bags labeled "sugar" on the shelf at Safeway would be terrorism. Dropping it into the HVAC system of a hospital would be terrorism. Transporting it to the US to supply consumer demand is criminal, to be sure, but it isn't terrorism.

And if you doubt it — which at this point you really shouldn’t, after 400 years of this — ask yourself how they can be so sure it’s a suicide when not only were there two of these lynchings, but when they’re not willing to conduct any investigation at all

I learned the extent to which national parks and memorials are already basically apologies to the Confederacy when I visited Gettysburg, a bucket list desire of mine. The museum literally barely mentions slavery (I looked because it seemed so odd) and half the displays are paeans to Confederate soldiers and officers including a loving display of a confederate uniform and glamour photos of Confederate officers. The park/battleground is FULL of monuments to Confederate companies (as in army, not commerce), but speaking of commerce the shop is at least 50% confederate merch. I was SHOCKED. You walk in to a /sea/ of Confederate flags. Appalling. I had no idea. (At the time the shop was run by the federal government/park service, so not some third party with a purely commercial motive.)

I've said before how one of the most profound things my mother ever taught me was that even though we were a family of 20th century immigrants, the history of America, ALL of it, including the bad parts, were now our legacy and our history.

Anyway, sorry for the wall of text and FUCK these guys for removing the few nods to our shared patrimony (sorry don't know the gender-neutral word for that) which actually exist.

And they will erase history to substitute their own. We've been fairly lucky up to now, in this country, in knowing our history, even if it was never taught thoroughly enough in schools. But now? Hell, they've been trying to turn MLK Jr., into a conservative white Republican, for a couple of decades, now. This regime will rewrite history in a way to equal and surpass Henry VIII.
