Hours after Donald Trump took the principled stand that he will sign whatever Congress sends him on the matter, a federal judge in San Francisco ruled Tuesday night that the administration can't dismantle Barack Obama's Deferred Action for Childhood Arrivals (DACA) program just yet. US District Judge William Alsup issued a nationwide injunction ordering the administration to renew DACA protections for anyone who was covered by DACA at the time of Trump's order in September, until a lawsuit by California A.G. Xavier Becerra and several other state attorneys general, DACA recipients, the University of California, and other plaintiffs is resolved.
Yeah! When things just used to run on automatic, you could just get up in the morning and assume the country was still intact and the government was still basically functioning without having to check.
does Donald Trump know that Judge Alsup is not actually on the 9th Circuit, but in the 9th Circuit's jurisdiction for this appeal? probably not. his talky person on the radio this morning said they would appeal from the 9th Circuit to ALL OF THE HIGHER COURTS, KATIE! which there is only SCOTUS above the 9th Circuit.
It's also worth noting that the judge took into account Trump's tweets that he has to get funding for his Great Wall (what happened to Mexico paying for it?) before DACA could be considered--a position he repeated in that public meeting with congressional leaders. That, of course, undermined the DOJ's position that DACA can't be allowed to stand because it was totally illegal in the first place.
