If courts are going to require that laws specifically say "no upskirt photos", then a lot of states aren't going to have an applicable law.

It's interesting to compare the issues on which courts go all "letter of the law" and the issues (second amendment e.g.) on which they feel less constrained by the letter (or entire phrase).

Absolutely. And no creepy photog needed. She put everything on display gleefully using her assets to increase her fame. Google more of the pictures, they make today's actresses 'nip-slips" look like amateur hour.

[Note: I don't actually believe that, and while I have to snigger when gingers say "Ginger-hating is the last acceptable prejudice"--like I snigger at anyone saying that--I don't like people hassling other people. However, it was one of the things I thought when I saw the picture.]
