She would record any license without her name affixed. Marriage licenses remain in county records permanently. Davis said, “I never imagined a day like this would come, where I would be asked to violate a central teaching of Scripture and of Jesus Himself regarding marriage. The General Assembly will be compelled to amend many sections of Kentucky law, not just for the issuance of marriage licenses, to comply with the recent Supreme Court decision.” The brief pointed out that the Governor can call a special session of the legislature, or he could issue an executive order about the licenses to later be codified by the legislature during the 2016 session. This is indirect civil contempt. The ACLU had to prove that Davis defied his order, this is why in the documents there is one from April Miller swearing that she attempted to get a marriage license after the stay expired. Just because Davis admits to the judge that she won't follow his order doesn't make it criminal contempt. Direct contempt happens in the direct presence of the judge, if you will. And it's civil because this is a civil proceeding, she isn't being charged with a crime in the lawsuit, that would be a job for prosecutors, not the ACLU.
