The sad thing about this case is that we've seen other similar cases in which the prosecutor knew they had the wrong guy but because they were dealing with a member of a hated group - Black people, it was OK to put them in prison for almost 30 years, until assisted by the Innocence Project. The broken down criminal justice system protects the crooked policemen who made the dirty arrests and then the prosecutors and up the chain. This is a third world country and until Americans start looking around at how much more advanced other countries are, the USA will continue to decline. Hell, we still struggle along with Amtrak instead of bullitt trains like the rest of the first world countries.
No way they'll be held personally liable unless they're convicted of their actions actually being criminal (which they should be, but it's very unlikely).
Lacking such a conviction, they were agents of the state, so the state will be liable, which isn't such a bad thing, given that the state can actually pay a judgement. I hope that judgement is pretty damned large.
I suppose he could bring a civil trial against them. And if he sues them as individuals it would come out of their own pockets.Any actual lawyers have thoughts on this?
