I agree with you. But unfortunately where I work, depending on who the other servers are it is impossible to even start your side work before the end of your shift unless your side work is no where near the window where the food comes out to be ran! Or it's dead which is very rare. And better be sure your done with wrapping your silver before it gets busy in the morning. Cause even when you are cut you still have to bring out whatever trays are in the window while your trying to get that done. been stuck there for over an hour maybe longer just trying to be able to do my side work and silver which if I able to just do it would take less than 1/2 hour. Plus I am an opener who goes in 1/2 hour before the store opens. So now we are talking a lot of times almost 2 hours of side work, and being a team player helping work. I can't complain about the money I make but geez that gets a little crazy!. Funny though some know how to hide from that window, or just arent noticed? I guess because the managers only focus on the ones who do work the hardest?I've been a server for over 25 years in about 4 different places this is the only place I just can't seem to be able to get out!!! you know what is also illegal? Not reporting your tips as wages which the worker quoted above obviously did. Otherwise, it wouldn't matter what percentage of your income is from wages and what percentage is from tips.
Also, if servers are paid 5 times what they are paid, who do you think is going to cover that additional cost? The restaurant owner? HA! Say hello to the $18 cheeseburger and fries!
A couple of busboys... At $15 an hour. If the costs of the restaurant already would balloon with a minimum wage hike, having to hire *more* people would make that even worse. I suppose with a wage hike you wouldn't have a problem with the servers doing the jobs then, though.
They buy the hamburger buns in bulk, the meat in bulk, the veggies in bulk, and everything else in bulk. Cost of making the burger? $6, What do they sell it for? $11.99. Do they have to pay the server more than a few bucks an hour? No. What do the restaurant owners do? Still bitch about being poor.
If the dead tree is large species, it could seriously injure people or even murder them outright. Not to mention cause expensive property damage.
There have been several cases in recent past in Washington, DC and suburbs where people have been injured and/or killed by dead trees (limbs snapping off whilst walking under/near, driving under or picnicking under).
A few of these tree tragedies happened on the National Mall. At least 1 person was killed and a handful of others injured.
If I remember correctly there were 2 different situations both happened on the Mall within a short time of one another. All parties successfully sued National Parks Service or city of Wash, DC.
After the 2nd incident, NPS arborists created a tree maintenance schedule to examine trees planted on the Nat'l Mall to remove dying, dead and diseased trees before they could murder again.
Other 2 incidents were in the Chevy Chase/Bethesda, MD area. A young boy biking home during a sudden freak storm with intense winds was hit by flying tree limb along town park path and killed instantly. And a mother and her young daughter crushed by huge dead tree limb dropping on the roof/windshield of their suv while driving along a busy suburban street.
Washington, DC gov't has asked visitors and residents to report diseased, dying, dead trees. The area is full of scientists, geeks and such - I know when the request was first made they received good info and promptly removed the dangerous killer trees.
If only these blood thirsty trees had their sights on all the bad people living and working here. It seems they only go after the pure and good. The woman who was killed in her car had the biography of combination Wonder Woman and Angel. She left behind 3 or 4 other children.
The young boy had been out biking with friends. The sky suddenly turned eerily dark in late summer afternoon and winds picked up. Realizing the strange change in weather the kids all said good-bye and hurriedly biked back to their homes but 1 never made it.
I was a GM for Ruby's for few years. The servers have 30 minutes of sidework for a 4 hour shift. That's 12.5% of the time which is under the 20%. They have a system in place that defines the side-work standard in all locations. This suit is going nowhere because they have all the documents to back it up including a scheduling system that shows guest counts and average tip percentage per server based on their credit card tips. The real crime is what they pay the cooks and dishwashers. They intentionally pay less than the market wage in the area.
I agree that diseased or dying trees near roadways and houses should be removed, as they are very dangerous. I was thinking more of rural areas, or state parks, though trees can fall on folks there, too.

You'll use a class action lawsuit, which in the best case scenario will make a handful of lawyers rich, while providing each aggrieved party with a swell check for $13.79. Meanwhile, Ruby Tuesday will either cough up the fine $ and continue chugging along, business as usual, or else declare bankruptcy and close up shop. Bravo! Well done!
