Fun fact: TFG’s response to Jack Smith’s Motion to Expedite the appeal was due yesterday at 10 AM, and Smith’s reply was due today (12/14) by 10 AM. BUT! That crafty Mr. Smith filed his reply yesterday, which was quickly followed by the panel’s order scheduling the briefing dates.
It should also be noted that the briefing schedule that Smith proposed and the panel granted - over TFG’s *strenuous* objections - has just slightly longer dates for TFG’s initial brief and Smith’s response than in TFG’s appeal of the limited gag order, where TFG was the one seeking expedited review. (However, no hearing date has been set as of yet in this matter.)
Finally, while TFG’s claim of “absolute Presidential immunity” for crimes committed while in office may be novel - in the sense it’s never been decided before - it is by no means “complex,” as TFG repeatedly asserts. As Smith’s reply correctly notes, this issue is being decided at the Motion to Dismiss stage, which means that all facts alleged in the indictment must be accepted as true.
