When the Supremes do their fucking dastardly work in the dark of night - i.e. use the shadow docket to say "we aren't taking this case" meaning "we aren't overturning the right wing decision that stayed a left-wing court case" are they not failing to establish legal precedent?
Because they haven't actually rendered a decision.
So what's to stop the lower courts from just saying "oh THIS case, that's completely different from that last case, and therefore not subject to the SC non-decision, because it was not the subject of the stay in the first place - is hereby decided with exactly the same results as that other case". Ad infinitum.
I don't know if anyone else has discovered this, but if you live in the desert, and it's summer, the fucking ants might send out a scout. And that spy will definitely notice if you have a box of pre-made taco shells. It's like having a bunch of crack cocaine in a neighborhood of crack addicts.
