"Insecure originalists may worry that they are subconsciously engaging in “judicial activism” in the service of their own policy preferences."

well, um, yeah. maybe. but in real life, i don't imagine you're losing much sleep over it, sammy.

Insecure Originalist is the title of my Elvis Costello interpretive-dance show.

"He’s also a religious extremist"... Say no more, this is explanation enough.

Why not, since they also tell us that collection of fireside stories from the Bronze Age is the REAL life manual. As if anyone could honestly derive a single, simple code from that huge farrago of self contradictory bullshit. You would have to hack and slash it to a nub to isolate an actual code that does not violate anything.

Ta, Brooke. "Sammy" Alito went to the same high school as Elder Sister, whose memory will always be a curse as well as a blessing. Nothing good ever came out of that school. Unlike ES, he went to Princeton. He's changed a lot since then, none of it for the better.

I kinda like that Brooke is trying to reframe it that forced retirement would be a mercy to poor old befuddled Alito, as the stress of being a Justice is clearly very bad for him, and he will live more happily, more sanely and perhaps even longer if he is forcibly put out to pasture.

It's an admirable attempt. And certainly less dishonest than everything Alito does every day.

But I'm personally convinced that everything he says is a lie. The only reason he is more extreme, more open and more erratic now than he was in the teens is because he thinks he CAN. And now, as he starts to fear that Democrats will win and Reform all his victories away, he has turned to gaslighting to try to undermine public support for shit-canning the Court's current ability to force his Catholic fascism down everybody's throats.

Headline in New York Magazine just now:

The Inescapable Hasan Piker

For good or ill, the Twitch streamer is now the most volatile force in American politics.

Because Stephen Miller apparently doesn’t exist anymore.

Seriously, can you imagine any publication saying this about a rightwing influencer?

What they meant was a nice, inoffensive centrist who would urge democrats to stop talking about universal healthcare and making billionaires pay taxes.

"... because he is old and lacks the ability to adapt, he becomes confused" And this is why I still have job recruiters calling me. What I learned at the start of my career has changed monumentally. I adapted ... I learned ... I'm still employed in the technology world that didn't have the internet when I started.

Dear Justice Alito: "Post-Reformation England" is one of the reasons the United States was founded and the Constitution written in the first place, you complete jackass. If you want to go back there to find some Catholics hanging out on rooftops to talk to them about gay marriage, go ahead. Feel free to stay. You'll fit right in.

My chief takeaway is that, to my surprise, the ancient asshole has a conscience and it sometimes bothers him but he stands strong against it. A torturer who wants the sympathy of his victims, he doesn't REALLY want to do it but he just HAS to. Oh, and he sometimes has a sneaking suspicion that he himself is guilty of that "judicial activism" that he and his allies claim to hate so much. In short, Podsnap redivivus. Poor baby. GDIAF you superannuated coprolite.

you are too generous.

Like most bigots, Alito has confused being silenced with not getting their way.

“As a result, they may welcome occasions when their originalist analysis leads to results they dislike.”

And what the actual fuck is this? The man has never in his entire tenure on the bench issued a decision that didn’t comport with his ideological desires. He always twists and tortures logic and facts to get the outcome he wants.

found in corners, and alleys, and cellars, and the housetops, or in the recesses of the country,’”

This is so so sad! Once again we are back to the Cake Wars - where poor put upon cake bakers have to make cakes - a sacrament - for the gay weddings. And, further, now they must hide and keep quiet their deeply help religious beliefs!

If it helps I - a GAY - give you bakers permission to refuse a cake! Provided you clearly mark your cake shop as one of those refusenik shops that cannot bake cakes for gays. Have a big sign on the door of your shop saying who you will and who you will not serve. It's fine with me.

But here's the thing - the weddings we are talking about are civil ceremonies - blood tests, notary, some guy at city hall does the 'ceremony'. Everybody has to do this I think. The big church thing with the big white dress and the tasteless sugary cake and feeding each other and god and I DO and so that - this something extra - Holy Matremony let's call it. It has it's own rules

So this way everybody is happy. THe GAYS get married, the church remains undefiled and the CAKES can be holy as well - untouched by gays

"For an originalist, the question presented in Obergefell was whether the term 'liberty' was understood to include the right to legal recognition of a same-sex marriage. It is impossible to maintain that the general public or lawmakers in 1868 understood the amendment as requiring states to recognize such unions. Yet that’s what the brief argued."

Liberty of marriage WAS very much understood to be implicit in the 14th Amendment in 1868, you lying putz! That liberty did not yet extend to same sex unions or even interracial ones, but it was well-understood that the right of former slaves to marry and have those marriages recognized and protected by the states, protections formerly denied to slaves, was implicit in the amendment and a part of the ratification debate.

Sigh. Thanks, again, Brooke for reading this turgid tome so that I don’t have to. I think of the poor trees that were sacrificed to make paper to print this excuse to collect a hefty bribe—I mean, book advance that sales will never recoup—and I weep. His literary agent must be dancing all the way to the bank. Mr Justice Alito is so worried about the fate of Catholics in post-Reformation, who were plotting treason against Good Queen Bess with King Phillip of Spain, who was torturing the Dutch Calvinists and the Spanish Jews with the Inquisition, who only sought freedom of worship. Catherine Medici was supervising the massacre of 15,000 Calvinists in Paris during the St Bartholomew’s Day Massacre, when the Seine ran red with blood. And in the Italy of Justices Alito’s and Aquino’s ancestors, the child of the Jewish Mortara family was ripped from their arms by Catholic police, who took him to Rome to be raised as a priest because his Catholic nurse had secretly baptised him when he had a fever, in a Catholic prequel to ICE. (Also, after WW2, not only did the Pope supervise the rat lines that smuggled Nazi war criminals to Catholic Argentina, but Jewish children were reluctantly (after delays of many months) returned to their Jewish parents who had survived concentration camps, because, once Catholic, always Catholic to Pius XII. Fascist.) This business of Catholics being persecuted by the English, when Catholic Guy Fawkes was going to blow up King James and Parliament in the terrorist Gunpowder Plot (Remember, Remember the 5th of November, and give the boys money for fireworks to blow up the old Guy), seems conveniently amnesiac about the Catholic atrocities in the Wars of Religion. Especially towards Jews. Going back to the Rhineland massacres and the Lateran Decrees, which made it illegal for Jews to own land and forced them to dress distinctively and to live in Ghettos, which were ghettos, all the way through to the Catholic willing participation in the Holocaust, Catholics are wayyy more sinners than sinned against, a fact that Popes John XXIII, Francis I, and Leo XIV are at pains to acknowledge and make amends for. Mr Justice Alito, please stop feeling and acting and voting like you are the persecutee, and recognize that you and the SCOTUS 6 are the persecutors. Then there is the self-pity about being discriminated against for being Italian. (I swear to God I am not making this up.) Mr Justice Alito was selling an earlier book and he talked about how Justice Aquino was the first Italian on the Court, as though that made him the Jackie Robinson of Justices. Brandeis and Cardozo, who were not even spoken to by certain conservative Justices because they were Jewish, and Thurgood Marshall, who had his share of racial prejudice to contend with on the bench, especially from Southerners like Potter Stewart, did not have to deal with the anti-Italian prejudice that Aquino and Alito have had too. As I bring this rant to a conclusion, I begin to wonder if Alito actually knows what it feels like or looks like to be discriminated against, like Blacks and Jews and Muslims and Latinos and women are, because he is too busy feeling sorry for himself as a fake martyr. I wish there was a way to screen potential Justices for emotional maturity and self pity, because a Supreme Court Justice has no business feeling sorry for himself. Fly your freak flag, Martha Ann!
