"Here’s hoping the new approach survives the new legal landscape, and that the Supreme Court won’t ultimately decide that 14th-century rules governing serfdom mean it’s unconstitutional."

This is a perfect encapsulation of Mitch McConnell's lifetime pursuit of stuffing the judiciary with right-wing hacks to enshrine conservative, minority rule. We can win elections, get progressive policies passed, but then slam up against unelected arbiters on stacked courts who will find any pretext, no matter how flimsy, to strike them down. We really need to fix the courts if we want any hope of a better future, from climate change to workers' rights to healthcare.

I hope these rules survive, along with so many others like capping insulin and forgiving student debt. And Dick Fucking Durbin needs to toss aside the blue slip bullshit and get as many Biden appointees in there as possible. There are so many empty judgeships, such as really important ones in FL, because of course Rubio and Voldemort strike down every single one. Fuck them and fuck the blue slip "rule."

I gotta' say, I am mightily sick of being told I need to start donating, either one time or by subscribing, when I've been a subscriber for far longer than you have been on fucking substack. Last I saw you were still pretty happy about talking my money every month so how about you just knock it off.

You went a little too far on this one for a joke, Dok.

I was a Lead Feral Hog De-Tusker, and I was damned proud to hold that title.

My De-Tuskers did good work.

No, no, no -- you have the framing **all** wrong.

Back in 60-70s, working straight 48 hrs/wk in hotel biz, I asked for a raise. Company, instead, sent me to Memphis HQ for ‘Senior Innhostess’ program (equivalent of lead feral hog detusker). Returned to duty with uniforms, a nifty ID pin, business cards and a salary that was less than my paltry hourly wage. That such horseshit has persisted into the 21st century is appalling. Go, Dark Brandon!

I'm sure they NYT and CNN will be reporting on this. Lol

They'll interview a half-dozen CEOs who happen to be hanging out at the corner cafe: "How am I supposed to run a business if my employees are constantly running away to the guy down the street, just because he pays 59% more?"

No doubt this is bad news for Biden and Democrats, I'm just trying to figure out how

A former employer of mine used these to keep folks ar0und who could easily make a lot more working for someone else. They would sue just often enough that other potential employers took it seriously. I hope they fucking choke on this.

As a working physician married to another working physician - HALLE-FUCKING-LUJAH!!!!

That noncompete bullshit is a RACKET. Hospital systems offer big salaried initial contracts to attract physicians, include the noncompete, then when they renegotiate the contract after 2 years, they totally fuck them over. Unless you're willing to move your entire life and family every few years, you see your income drop, drop, drop while your workload goes up, up, up...

Now, my husband - ever the scrapper - threatened to take his medical system employer to court over the noncompete a few years ago, and based on a prior case, they decided to just fire him without cause, which freed him from the noncompete AND gave him 3 months severance! Which was nice, because he ended up starting at his new job just as Covid shut the world down, meaning he didn't really get back to work for another few months, so that little cushion of income came in handy.

Now, when I first heard about this, I didn't think it would apply to physicians (we get left out of a lot of labor issues, and TBH, most of us are doing just fine financially, even though we are getting quite screwed relative to the non-medical executives who are making all of the decisions) so I'm really thrilled that we're included!! I really, really, really hope this helps with the physician shortages that plague so much or this country!!

It actually fucked over a friend of mine, who is a doctor and wanted to hire another doctor to join his practice, but it turned out the prospective hire was subject to a non-compete so he ultimately couldn't take him on.

These are restraints on trade, and any supporter of the free market should oppose them!
