Too bad Dominion settled ‘cuz a guilty verdict there would have been pretty good evidence that Fox News has a history of maliciously promoting lies.

Remember also that a key part of Fox News’ defense was that their talking head shows were ENTERTAINMENT, NOT NEWS and that reasonable viewers already know this. Their words, not mine.

If I was a Democratic media consultant, I would be pushing that message all the time. Fox News knows its viewers are dupes, its disinformation is not fact, and they will admit it in court when they think they’ll have to pay out.

The Biden administration should have revoked their White House press pass.

Sure, in civil court, once you have established that a case has merit, you're allowed to go on a fishing expedition for more supporting evidence.

Aside from the answers you've already received below, discovery usually involves the exchange of documents pertaining to the issues of the case. So if someone was dumb enough to put in an email something implying that they knew the on-air statements were untrue? That's really bad for Fox News.

Basically discovery is a pre trial investigation of the evidence and witnesses which will be involved in the trial. Both sides get to ask questions which can lead to some interesting info coming out that can fuck people over.

I'm not a legal professional but it's my understanding that the discovery aspect of a trial involves the revelation of the down and dirty details regarding the legal specifics of the case too many plaintiffs would prefer to keep on the down low.
