The tort is defamation: Trump saying "Carroll is lying" is his denying that Carroll is telling the truth. That is the actionable statement. Saying the Carroll is "too ugly to rape" is NOT defamatory. It's vulgar, rude, terrible . . . but NOT defamatory. So, conceding that Trump's denial is in the course of his employment (regardless of what else you say about his "too ugly to rape" comment) gives away the ballgame.
I feel so squicked out by this case on a good day (Armageddon-wise). The discussion being held by these Federal level judges gives me an absolute migraine.
