I think it's scarier. Gaetz is a decoy, designed to draw fire. With everyone's attention and arghhh directed at him, a yawning chasm of relief/meh will open up when his nomination gets withdrawn (likely by Gaetz himself) and a "more qualified" name replaces his.

Imagine the worst: Ken Paxton. Matt Kacsmaryk. Aileen Cannon. James Ho. Any of these will inevitably be compared to Gaetz. By that standard they will look like Thurgood Marshall--at least to the GOP senators seeking cover for their final submission to the dictator.

Gaetz's resignation of his seat could only apply to the current Congress and not the one he was just elected to that convienes on 3 January. So he might be out of Congress for only a few weeks.

Wouldn't the report on him come out then? Also his stated reason was so Puss in White Boots could appoint his replacement before the new term began, so he wouldn't have a seat to return to if not confirmed.

The Ethics Committee lost jurisdiction to further investigate Gaetz when he resigned from Congress, though the report could still be made public. I have no idea what would happen if Gaetz served in the incoming Congress, but it is possible that the Ethics Committee would have to start over on their investigation, though they could rely on information already gathered.

All vacancies in the House have to be filled by a special election per Article I of the Constitution. DeSantis cannot fill the seat by appointment.

If Gaetz is denied the Attorney's General appointment, then he can claim that he is the elected Representative for his Florida District, and the House would have to seat him. A special election would only fill his current seat, not the seat he just won.

Oh, was that Ethics Committee report coming out now? Darn the luck, anyway. Now Attorney General Nominee Gaetz will have a cloud hanging over his head because now that he's resigned his seat, the Committee doesn't have jurisdiction over him. So the report, which doubtlessly totally exonerates Gaetz will never become public. Just bad luck for Gaetz, plain and simple.

But Republican Senators, even the Fusty Fussbudget of Furrowed Brow herself, Sen. Collins, say they'll have some questions about the Gaetz nomination. All kinds of questions. Maybe even lots of questions. And if Gaetz listens to those questions (or pretends to listen, we don't know) and never answers them, then the Senate will have no choice but to confirm him.
