While Pence, as VP, was technically the President of the Senate he was not a legislator. The Speech and Debate clause, as written in Article I, applies to legislators in either house of the Congress. Pence is not a legislator.

This tactic will fail. It is, at best, a stall. Pence is trying to have his cake and eat it, too. Why is he trying to protect the man whose followers wanted to kill him?

I agree. He's an executive, moving from one branch to another branch-- to vote, but to vote as a special executive voter. Take it from me (world's foremost authority) But, I think I'm right. But if a distinguished lawyer thinks it's brilliant, it is.

OK but why can't Jack Smith say "OK, we won't ask you any questions about what you did while in speech or debate on the floor of the Senate, and also live on television while millions watched. You can keep quiet about that and hope no-one finds out about it. Now let's please have your testimony about everything else."

This is why I say "the law" isn't based on objective facts, but rather subjective opinions of lawyers, prosecutors, judges and the jury.

If it was based on pure facts then you wouldn't need "good lawyers", any old attorney could argue your case on factual merit. 😆
