Defamation, unfortunately for wingnuts like Lindell, isn’t mitigated by the speaker’s feelings. It matters not if Lindell was filled with patriotism in his heart when he smeared a private citizen and turned an irrational mob against him. Coomer will always live with fear and anxiety now, and his privacy will be expensive. I hope the Newsmax settlement was for several million, and I’d bet it was, because even a verdict against Lindell might not be worth a tube of mustache cream.

I don't think he has access to these defenses but they exist.

Don't trust me about legal things. Check Nolo Press or another reliable source.

One defense is that something is just talk and not a statement of fact. It would not be defamation for me to say Mike Lindell was a poopyhead, even if he weren't.

Defending against a "public figure" suing, honest research is a defense. For them to win they have to show "actual malice" or "reckless disregard for the truth", neither of which means what you'd think.

But in this case he alleged specific crimes and didn't seem concerned with the truth of what he said, in my opinion.

Coomer is in no sense a public figure. He's pretty much the textbook definition of "not a public figure." But I agree that Lindell is unlikely to meet the Sullivan test even if it applied.

This should be a reminder, the Drumpf cult will NEVER let go of their Lost-Cause stolen-election narrative, because it was not about whether Trump could have won but their "right" to use democratic processes when it is to their advantage and deny, subver and overturn the results when they lose. The only solution short of using martial law to arrest them was for the "mainstream" media to stop covering anything Trump or his allies said.

I actually feel sorry for Lindell. He’s clearly suffering from an untreated mental illness that has already destroyed his lumpy pillow business. If there is anyone in his life who truly cares for him, they should hold an intervention.
