People can be arrested and charged with a crime if they are carrying "burglary tools" which are loosely defined as being anything that can be used to force entry into a building or pick a lock. The charge can be deemed a misdemeanor or a felony that can bring jail time. So, walking around with a hammer and screwdriver in your backpack can get you in trouble but carrying a loaded gun is A-OK.

The case against him would be a lot more clear-cut if the people who followed when he tried to disengage had not initiated a physical attack - which was in process at the time the shooting occurred. The guy shouting "get his license plate" had it 100% correct.
His lawyer will undoubtedly argue being previously belligerent doesn't negate the fact that ultimately, he, tried to leave - and that others subsequently persisted to initiate a physical altercation that resulted in the shooting. That assertion is well supported by the video. It feels like it will come down to if he can plausibly argue the situation made him afraid for his life - provided NM doesn't have some kind of screwed up stand-your-ground law that might somehow apply..
Another big factor is likely to be who, exactly, was shot. It kind of *looks* like the gun was pointed at the guy in a balaclava who was actively hitting the shooter with a skateboard. If so, I honestly see a decent chance a NM jury would not be willing to convict. OTOH, there will likely be an entirely different reaction if he shot the woman.
