Drejka was attacked, physically. The attacker was a continued threat. This is an excellent law and protected Drejka, and was used correctly and legally. The attacker also could of got in his car and left the store instead of attacking. Leaving the store lot would have protected his baby mama and himself.

An arrest should be automatic when a civilian kills another civilian in a public place (not a home invasion). Then, it's up to the DA as to whether there is enough evidence to prosecute.

Doesn't have to be in fear for his life. He just has to be in fear of a forcible felony or great bodily harm and you pretty well made that case for him with your little diatribe. It's all on video with eye witnesses and McGlockton clearly started the criminal altercation. There's nothing McGlockton could add even if he hadn't gotten himself killed because McGlockton couldn't even manage to control his raging temper long enough to discuss the situation he just attacked without a word being spoken between the two. It cost him his life.

Sorry to tell you but engaging in the legal activity of criticizing somebody for parking illegally is not "starting an altercation". It's simply engaging in a legal activity. The altercation started when McGlockton committed violent unprovoked battery on Drejka which is a crime under Florida law, just so you know.

If it makes you feel better SYG is only the no duty to retreat part of the law and since Drejka was knocked to the ground and had no realistic option to retreat that portion is irrelevant and he would have been just as justified in killing McGlockton without it, if that makes you feel better.

You sound butthurt over yet another violent thug's demise. Like you the thug apparently believed that he had the right to attack a man for "starting shit" by daring to explain to his girlfriend what a handicap parking sign was. His behavior was quickly corrected by a bullet in the chest and Drejka is going to walk free and clear so I expect your butthurt is only going to get worse.

The problem with your theory is that Drejka simply stuck to words when making contact with the parking scofflaw. He didn't yank her door open, and slam her to the ground which I'm sure would have been McGlockton's preferred approach given his battery of Drejka, a battery which didn't turn out exactly the way he wanted to. Either way he's not dead because of any stand your ground law, he's dead because he chose to violently attack a man over nothing.

The cops did an investigation here too and the first thing they learned was that the shooter was violently slammed to the ground by the deceased before shooting him. Want to guess how it goes from here?
