Calling either of them a "swing" vote is pretty over-optimistic.

Incidentally, the composition of the SCOTUS is my principle argument for folks who are upset that Bubba and O aren't really very liberal. Just think what the Court would look like without those two breaks in the Republican presidency.

So if voters pass a clearly unconstitutional law (like say, personhood begins at conception), it must be upheld because the voters approved it?

Justice Kennedy should not be taking lessons on how to develop a compromise decision from former Chief Justice Roger Taney.
