But when slaves escaped to free states in the U.S. a couple of centuries ago, the spiritual ancestors of these bastards were quite okay with the Federal government meddling with state laws to send the escapees back to their "owners". Yeah. The Consititution is sacrosanct except when it's inconvenient, and states' rights are sacrosanct too, except when they are Yankee states. Hallejujah and yeeeee-ha.

Because as we all know and as recent events like Jan 6th and the Trump trials have shown us, law enforcement is inept and it's easy to dodge a rap in the Union as long as you have influence and friends in high places (or a cult-like voter base, that helps too).

Hard to believe that 4 justices are willing to disregard black letter law- in fact, the constitution itself- and blatantly rule against the supremacy clause when it comes to border enforcement. It doesn't get any more clear cut- Abbott doesn't have a leg to stand on (so to speak), the state can't simple usurp federal powers such as control of federal borders because it feels like it. Actually, in this upside down timeline, it's NOT that hard to believe. In fact, it wouldn't be that hard to imagine this ruling having gone 6-3 the other direction, considering what utter partisan hacks our current piss poor excuse for jurists the pseudo conservative majority SCOTUS have proven themselves to be...

Since I assume you were asking a question in good faith, I'd like to explain that, if the Men of Texas did as you vaguely suggested, they'd be arrested for murder when they killed a brown-skinned person, tried, and, if convicted, spend a lot of time in jail.

And, it'll be federal charges, so there'll be no Texas so they walk thing.

Four out of nine justices were fine with Texas killing people at the border and held that the supremacy clause only applies when republicans are in power.

This is where we are in 2024. Saved only because pushing children into razor wire was a step too far for Barrett and Roberts.

This is why I think the Court will tell Trump to get fucked regarding his absolute ability to do anything he wants. Like the Supreme Court is going to abrogate its own power and had it to the Donald, who might just make any justices he dislikes…disappear.

Of course, when asked for the three co-equal branches of government, Trump probably answers: Executive, Congress, Camel.

I strongly suspect a brief order not reaching the merits was more a matter of procedure than a signal of any shift in constitutional principle. For the conservative activist majority, addressing a supremacy clause issue in the context of immigration is like asking them to talk about their fantasy football team. So, so much more to say and you aren't gonna want to listen to any of it.
