It has been decided that I will minimize disruption at work and be here until we have people to cover the floor, and after that I’m schlepping to the hospital for round three. Stupid as it may sound, I even packed the extra-long charging cable that works on my phone, tablet, and Chromebook.

I mean, is a “scoop” even valuable anymore. Sure 40 years ago when cable news and the internet didn’t exist getting a story first meant having a huge jump on the competition. If CBS got it first you might stay on that channel while it played out because it would take time for other news agencies to catch up. It might make some feel they are the “go to” for breaking news. But now? Once they posted the story it was all over the internet and cable news in minutes. All she gets is to brag “You heard it hear first!” and everyone else can say “Yeah and then 30 seconds later I followed the story on a site I like”

I am writing to urge your support for state legislation modeled on the New York “Reciprocal Enforcement of Claims on Unpaid or Reduced State Entitlements Act” (“RECOURSE Act”), which would provide a state with legal tools to respond when the federal government fails to disburse funds already lawfully owed to the state by statute or court order. New York Senate+1

Currently, the RECOURSE Act being considered in New York would require the state Comptroller to report on federal funds owed to the state — including those the federal government failed to pay “in contravention of a court decision.” The bill would then empower the executive branch of New York, acting jointly, to withhold payments otherwise due to the federal government in an amount equal to what is owed, as a form of reciprocal enforcement. New York Senate This mechanism is an important step toward enforcing fiscal reciprocity and accountability in state–federal relations.

States have long been concerned about the fiscal impact of federal actions that impose significant obligations without adequate funding. At the federal level, the Unfunded Mandates Reform Act of 1995 (UMRA) was enacted by Congress to curb the imposition of unfunded federal mandates on states, and to require cost estimates and consultation prior to the imposition of significant intergovernmental mandates on state, local, or tribal governments. The existence of UMRA reflects a recognized need for accountability and transparency when the federal government places costs on states. Wikipedia+1

In the same spirit, a state-level statutory mechanism to withhold or condition payments to the federal government when funds owed to the state go unpaid could:

Encourage full compliance with federal statutory funding obligations and respect for court judgments requiring such payments.

Protect the fiscal integrity of state budgets by ensuring that federal entities cannot withhold state-directed funding without consequence.

Reinforce principles of cooperative federalism by requiring transparency and reporting on federal compliance with funding statutes.

This proposed law should be crafted with clear definitions (what constitutes funds lawfully owed, relevant court decision triggers, and limits on withholding), appropriate procedural safeguards, and legal review to avoid conflicts with existing federal statutes or constitutional principles. Consultation with state legal counsel, legislative counsel, and federal–state fiscal experts will be crucial to ensure that the legislation is both effective and defensible.

I respectfully ask that you support introduction or co-sponsorship of state legislation along the lines of the RECOURSE Act and collaborate with stakeholders on refining the language so that it can serve as a model for other states seeking similar protections.
