I asked some lawyer friends doing the impeachment, and I'm legitimately curious.

I watched the...events leading up to Jan. 06, and later I saw Trump's defense team lean heavily on Brandenburg, and my first thoughts were basically that from my non-lawyer understanding, doing back to the understanding of Brandenburg I was given in high school, it didn't seem like the strongest defense for Trump's team? I'd like to ask some lawyers honestly....

because I know that it's a high standard. You have to basically incite something specific, with intent, and then the person/mob has to do that specific criminal thing you told them to do, then. Which is a high standard, but also pretty much the case study I was given in high school was "shithead tells a crowd to violently burn down a building which they proceed to do, threatening the lives of Congress Critters and the VP in the meantime, and bashing a cop to death with a fire extinguisher..."

but then when I saw his legal team brining it up I thought to myself that I may be missing something and should ask some lawyers, ....

Someday could you grab it and we could see a picture? I bet it was brownish felt. Like that one Ma Barker used to wear with her house dresses.

Why? It worked for Republicans. Maybe we can get Democrats just as riled up with the truth as they did with lies, but do it with votes.

Civil suit, burden equally divided, "preponderance of the evidence" is usually translated "more likely than not".

Why would it be difficult to show intent?

I am not a lawyer, but have had things written for non-specialists which said just what you did, that actions before and after can be used as evidence of intent.

Breaking an oath of office is perjury so if you want to toss another log on that fire, Eric, have him charged for that, too.

Blatant self-disregard or just poor planning? Though the stick shift might have been the safest bet, they don’t use as much coolant

There were people like that...even in WWII. There were war profiteers, there was a 5th column of spies and saboteurs, there were criminals running a black market. There has been and there will always be shitty selfish people.
