before I finish the article: all 9 of our SCOT justices are elected. if someone leaves midterm, the governor appoints a successor and they are up in the next general election for a vote. this next part will make me gag, but I'll get through it: Rick "Gov. Good Hair" Perry actually did a good job of appointing qualified Latinas/Tejanas to SCOT and the Texas Criminal Court of Appeals *hork* but they were often replaced in the next election by a white guy who said, "gee whiz! she sure does a good job, but I'm a white man, so I can win this seat!" the only time that a Latina appointed by Perry was not unseated was when her opponent was a Latino/Tejano. now excuse me while I guzzle a gallon of Listerine and finish the article.
also, too: SCOT recently ruled on the much bigger school funding lawsuit that (paraphrasing here), "Texas legislators are terrible, horrible, no-good, very-bad people and should have a good long think about how to not be so fucking awful. but the state constitution rests school funding and school policy squarely in the lege's hands so only they can decide what is right and what is wrong as far as school funding and policy goes. however, Justice Willet happens to think their decisions lately have been full of shit." so this ruling is basically keeping with that theme.
And make things even worse over there, especially for the intelligent rational people who happen to live in Texas? Do you have any idea how bad it make get without the constitution, the US supreme court, and the federal government holding them back?
