In any event, I can’t think of any circumstances under which the DOJ is going to turn over classified documents, which by definition CANNOT be subject to attorney-client or executive privilege. The risk is just too great to let the order stand as is. Even if the SM manages to get all the required clearances, what happens if/when there’s a dispute, and the judge weighs in to resolve? DOJ sure as fuck isn’t going to hand over classified documents to this judge.
I really, really hopes she takes the off-ramp and grants the motion to stay, but my faith is limited. For the love of dawg, woman, at least try putting national security ahead of TFG’s hurt fee-fees!
