6-3 at least. They can&#039;t overturn <a href="http:\/\/en.wikipedia.org\/wiki\/Wickard_v._Filburn" target="_blank">Wickard v. Filburn</a> without blowing up seventy years of prior jusrisprudence. Even Scalia will grudgingly go along.
