Don’t forget the fact that we have Alito because O’Connor had enough awareness to retire at a time when she knew she would be replaced by a conservative justice.

I guess there was a paper and history shortage that required brevity and consolidation.

But before vigorously dissenting (or, come to think of it, at any other time) I have never urged the majority of my colleagues to alter their honest view of the case because of the potential ‘damage to the Court.’

I read that as a knock on Kennedy's move.

As a former retail serf, first of all, THANK YOU for remembering your past and continuing to see the rest of us. Retail is the lowest slot of the low, and it’s not because they hire teenagers. Most stores DON’T hire teens or young people. Most of the retail frontline I see are older, even middle aged people, who are constantly sacked and reshuffled from bottom rung job to bottom rung job. I won’t call it slavery, because that’s a real thing that still exists, but it’s damn close.
