Hell, they can't even get non-criminal reports right. A few years ago I was in a single-car accident - someone not too far ahead of me had lost a wheel which ended up rolling into the leftmost of three southbound lanes, which was the one I was driving in during fairly heavy commuter traffic at around 75 mph. I probably would have been OK if I'd jinked around it on the right side, except there was already a car there, so I tried going around on the left, and to paraphrase the great James McMurtry, I tried to miss it but I didn't quite. It got the outside of my right front tire and actually caused an airbag to go off. The state patrol showed up and took my report. A couple of weeks later I received the report to submit to my insurance company and I was astonished to see how wrong it was. There were several details that were incorrect, but the most damning was that the trooper said I was going northbound, which would have been impossible from any possible recreation of the accident. Fortunately, State Farm accepted it and paid for a new airbag, tire and alignment.
I'm thinking drive-by commenter? Although I admit to being curious as to who "The Contentious Otter" is and why he thinks he's their worst nightmare. I'm guessing he's a Disqus stalker and Contentious is a lib he likes to "own" (in his own mind, at least).
I admit it. I do not get this. I do not understand why anyone would get up and say, "Here's what we're willing to back down on, in case any of the people we are negotiating with were wondering." This is not a tactic with which I am familiar.I don't get it either -- unless he's just signalling "this is a thing I don't actually give a fuck about, we just put it in there to mollify the progressive wing."
I don't have a problem with qualified immunity for officials who are doing their job properly. However, the way it's applied to police today, it protects them even when they are doing their job improperly. That part of qualified immunity needs to go.
It's not necessary to make it all or nothing. Make qualified immunity a defense that you have to assert and provide evidence that you were doing your job in an appropriate manner.
Qualified immunity and community policing are the two that need to pass. Please don't wimp out Democrats: otherwise will be stuck "bi-partisan"-ing everything down to near useless.

Just want to mention that New Mexico got rid of qualified immunity this year. However the rate that cops murder citizens at has not changed.

Yes, this. Why is disproving the QI defense ever a plaintiff's initial burden, instead of establishing it being the defendant's burden?
That's why I don't trust us to fix Qualified Immunity: QI got to be the way it is because courts were willing to stretch it into its current shape.
