If PAB actually files an appeal, instead of merely huffing and puffing about it, that's GOOD news for Carroll. It means PAB has to pony up the damages, up front, and put them in escrow. So when (not If) the appeal's dismissed with contempt, she'll get paid.

In the civil context you have to sue the lawyer for malpractice. The problem I see for tfg is that he has to show damages. How many of us think that the jury's award was due to his behavior, not her incompetence?

Thank you, I didn't go the expensive route this time, had splurged on Cristal in anticipation of the docs case being on a "rocket docket" but we unfortunately had a failure to launch issue, due to the judge having been appointed by the defendant. Hope it keeps well, J6 case will do, if SCOTUS upholds the Constitution.

Even IF he's telling her to beclown herself, she's under no obligation to DO it. As you say, it's utterly mystifying why so many people sacrifice themselves, apparently willingly, for such a broken reed. I understand it happening while he was (shudder) President - there was a LOT of potential reward for sucking up. Now, however, it's a long shot at best.

It's not unusual for a client to secure appellate counsel different from the attorneys who handled the trial. Appellate work is a highly specialized area of law, far more rigorous and detailed than negotiating parking lot deals and getting dunked on in a trial when a person doesn't know how to introduce a document into evidence.

But I think it's humorous that Needy Amin stabbed out a due process whine with his stubby little thumbs while simultaneously conceding that he had not one but two trials. How much more process does he "think" is due? He blew off the liability portion of the case, and only got interested in the penalty phase when it became apparent that he was in the path of Hunter S. Thompson's million pound shithammer.

Trying to second guess Stinky's "thought" process is iffy at best, but he seems to be fumbling toward a kindergarten-level claim of double jeopardy.

IANAL, but if I'm to understand what happened here... He had two trials because E. Jean sued him for defamation and won, and then sued him AGAIN, because he just couldn't keep his mouth shut, and won AGAIN.

She sued him twice for two or more *separate* instances of defamation; he didn't have two trials for the same thing.

If I rob the same bank twice on two different days, I would get two trials, one for each robbery.

He was sued once for sexual assault and once for defamation. He was found liable (not the same as criminal guilt) for both, by a jury for the SA and by default for the defamation. If you rob the same bank twice on two different days, you would get one trial with 2 counts of robbery, unless the 2nd robbery occurred after the actual start of the trial. Jeopardy doesn't attach until the start of the trial itself (in other words, pre-trial motions don't matter with regard to Jeopardy). He could be sued again for defamation, even by Carroll, but it would have to be a new instance of defamation. Just some clarifications :)
