The thing with white people is they don't have the natural, genetic predisposition to criminal behaviour that coloured people have. So it's only fair to give them a second chance at answering police questions. It's just a form of affirmative action, in a way.

As a former lawyer, I can tell you that Papadapoulos' lawyer is doing their job by making those arguments. They have an ethical duty to zealously advocate for their client. But believe me, those lawyers are not stupid, drunk or high enough to believe a word in any of their legal briefs.
